Tabcorp Fined Over $4 Million for Spam Law Breaches

Australia’s largest betting company, Tabcorp, has been fined more than $4 million for breaching spam laws, after the Australian Communications and Media Authority (ACMA) found it sent thousands of unlawful marketing messages.

The regulator revealed that Tabcorp sent over 5,700 illegal messages to customers involved in its VIP program, which provides personalized and direct communications about Tabcorp’s services from company representatives or agents.

Between February 1 and May 1, 2024, nearly 3,000 SMS and WhatsApp messages were sent without giving recipients the option to unsubscribe. Additionally, 3,148 messages lacked adequate sender information during the same period.

Furthermore, eleven SMS messages were sent without prior consent from recipients, between February 15 and April 29, 2024.

Under the Spam Act 2003, businesses are required to obtain explicit consent before sending marketing messages. These messages must also include a clear and functional unsubscribe option and sender identification.

The ACMA noted that gambling-related marketing often involves personalized messages offering incentives such as bonus bets, deposit matches, rebates, and tickets to sporting or entertainment events, which makes compliance crucial.
