Will Smith is back in the spotlight for troubling reasons as a violinist has filed a lawsuit accusing the actor and his company of firing him after he reported a sexual assault incident during a tour.
According to the complaint, musician Brian King Joseph alleges he was unlawfully terminated following an incident on Smith’s Based on a True Story tour in Las Vegas in March 2025. Joseph claims the actor engaged in what he described as predatory behavior and said he believed he was being groomed for further exploitation.
The lawsuit, filed on December 31 in Los Angeles, outlines disturbing details. Joseph says he returned to his hotel room, booked by Smith’s team, to find that someone had entered and left behind a sexual note, wipes, HIV medication, a beer bottle and hospital discharge papers belonging to another person. The handwritten message reportedly read, “Brian, I’ll be back no later 5:30, just us, Stone F.”
Joseph says that when he reported the incident to hotel staff and tour management, he was accused of lying and blamed for the situation. Five days later, he says he was fired and swiftly replaced by another violinist. He argues that the reasons given for his dismissal were merely a pretext.
The complaint states that Joseph had been hired in November 2024 and that after joining the tour, he and Smith spent increasing amounts of time alone. Joseph recalls Smith telling him, “You and I have such a special connection that I don’t have with anyone else.”
Joseph says he reported the hotel incident to a nonemergency police line but was later shamed by a member of Smith’s team before being informed of his termination. He claims he has suffered PTSD and financial losses as a result and is seeking damages to be determined by a jury.
As of now, neither Will Smith nor his representatives have issued a public response to the allegations.
