Employer Group Demands Crackdown as AI‑Generated Claims Flood Fair Work Commission

Australia’s peak resources employer body is urging a major overhaul of the Fair Work Commission’s claims process amid a surge in baseless and AI‑generated applications that are overwhelming the system.

The Australian Resources and Energy Employer Association (AREEA) has called for the current $89.70 filing fee to be lifted to $500, arguing that stricter scrutiny is needed for fee‑waiver requests. The group says there is now “virtually no downside to having a crack,” pointing to a recent case involving a Woolworths worker that was dismissed as evidence of how easily frivolous claims can be lodged.
The rise of generative AI tools such as ChatGPT has made it possible for applicants to produce detailed submissions in minutes, contributing to a spike in claims that employers say are clogging the Commission’s workload.
A government spokesperson confirmed that options are being considered to support the Commission, including potential amendments to the Fair Work Act. Workplace Relations Minister Amanda Rishworth has previously said the government is examining “all possible options that don’t dilute the rights of workers,” signalling that any reform will need to balance efficiency with fairness.
The debate highlights growing tension between protecting workers’ rights and preventing misuse of the system at a time when digital tools are reshaping how disputes are lodged and managed.
