A U.S. federal appeals court has ruled that the majority of tariffs imposed by President Donald Trump were unlawful, saying he overstepped his authority under the International Emergency Economic Powers Act and acted without congressional approval. The court emphasized that, under U.S. law, the power to impose tariffs rests primarily with Congress, and the president may only exercise such authority in narrowly defined circumstances.
In the 7-4 decision announced Friday, judges found that most of the recent additional tariffs on countries around the world were enacted without the required consultation with Congress. The ruling is set to take effect on October 14, giving the administration time to appeal to the Supreme Court.
Reacting to the decision, Trump called it ‘divisive and wrong,’ warning that if enforced, it would severely damage the U.S. economy and harm national interests. He vowed to challenge the ruling in the Supreme Court, expressing confidence that the United States would ultimately prevail.
